Freedom of Information
Freedom of Information Act 2000

The Freedom of Information Act 2000 came into force on 1 January 2005.  All schools should have adopted a publication prior to the Act coming into force.  The DfES and Information Commissioner sent letters to you in 2003 endorsing the model publication schemes:

DfES Model Publication Scheme
DfES Model Publication Scheme Letter 16-09-03.doc

IC Model Publication Scheme
IC Model Publication Scheme Letter 16-09-03.doc

There are separate model publication schemes for Primary and Secondary Schools.  Special Schools crossing both age ranges should adopt the Secondary model. Nursery Schools should adopt the Primary model.

Useful guidance for schools on how to comply with Freedom of Information legislation can be found here:

It is also recommended that schools adopt Birmingham City Council’s Code of Practice for Rights of Access under the Freedom of Information Act 2000.

Knowing what data your school actually holds is critical to effective compliance with Freedom of Information legislation.  A memo from Birmingham City Council’s Legal Services explains school record retention briefly.

The Records Management Society of Great Britain have also produced guidelines on record retention for schools:
